Legal Disclaimer

Shipping and Delivery

  1. Shipping quotes are valid for 30 days unless otherwise stated.

  2. Harbottle Audio reserves the right to change or alter the terms of the shipping quote or the quote itself.

    • ​The quote may increase or decrease due to market fluctuations.

  3. Duties and Customs fees are not included, please check with your government import agency for import fees​.

  4. The customer is responsible for clearing access to the delivery door. If the pathway to your door is not clear and free from obstructions, your item may be delayed or not delivered. 

  5. When an order is considered to be shipped is when the shipping documents are created. From that point on, shipping logistics and organization is handled by the shipping company. Logistics and trucking can take time to organize and is out of our control, we request your understanding.

  6. We buy Door to Door delivery service. DO NOT ASSIST THE DELIVERY PERSON.

    • If the delivery person can not complete the delivery by getting the shipment to your door or is not using the proper equipment and is struggling, they are the ones that have to rectify the situation, not you.

    • If they are being stubborn and/or looking hopeless and ask for help, remind them that the conditions of the service bought by Harbottle is Door to Door delivery and the laws that govern workplace safety dictate that they need the correct tools for the job.

    • Delivery services have policies that determine what kind of truck and piece of equipment is used for any given size and weight and delivery location. 

    • The weights and measures are provided so their company should provide the tools needed to complete the work as per the waybill or their dispatcher should reroute the delivery to a unit (truck) that is equipped for the work.

    • Government work laws are there to protect the worker. If they are ill equipped for the work and it is obvious, speak up out of concern for their well being.

    • If you interfere with the delivery, you may be held liable for the well-being of the delivery person in that you technically are assisting them in a way that prevents them from doing their job according to the workplace safety laws and the policies of their employer. 

  7. ​All shipments must be inspected at the time of arrival.

  8. Obvious damage must be reported within 48 hours and the package must be refused.

  9. Non-obvious damage or performance issues must be reported within 15 days.

  10. Damage of any kind or performance issues reported outside the stated time frame will not be taken into consideration.​

  11. If the customer is not available to receive the product, they must provide an alternate shipping address with 2 weeks advance notice. Failure to notify Harbottle of changes in availability will result in any and all additional fees being charged back to the customer. 

Domestic Shipping within Canada

  1. When an order is considered shipped is when the shipping documents are created. From that point on, shipping logistics and organization is handled by the shipping company. Logistics and trucking can take time to organize and is out of our control, we request your understanding.

  2. Shipping within Canada is handled by LTL or a limited number of couriers that handle heavyweight shipments.

  3. There is no tracking information and no guarantees of delivery dates. This is because the shipping system for large items in Canada is one of the worst in the world as it is set up by territorial corporations instead of logic and reason.

  4. Tracking services for LTL shipments is unreliable in Canada.

  5. Shipping within Canada can take up to 2 weeks.

  6. Postal codes with two zeros will have a surcharge added as these areas cost about double to deliver to.

Order Policies

  1. All sales are final.

  2. Deposits are not accepted.

  3. As our product is made to order with a certain level of customization, provisions for cancellations and refunds are not available.

  4. All product is made to order, manufacturing lead times are part of the order process and will vary.

  5. Posted lead times on this website and by email inquiry are estimates only.

  6. All custom and prototype orders have a estimated 12 month lead time from the time payment of the order is completed, with provisos for extra time needed to complete the job to LDLC standards, unless otherwise noted. Target shipping dates are not a guarantee on prototype and custom work.

  7. Change Orders:

    1. Change orders may be accepted with the understanding that the lead time will change.​

    2. Adding to, or upgrading the order will extend the lead time. 

    3. Changing the finish color or material will extend the lead time.

    4. Change orders may incur a processing fee.

    5. As points 7.1 to 7.3 are dependent on the amount of work to fit those changes into the build schedule and the changed demand on and stock quantities of parts, the lead time for the changed order will reset back to day zero and the order will be treated as a brand new order. 

    6. If 7.4 and 7.5 are conditions that you are not comfortable with, we advise that the order be left as originally paid for. 

  8. As our product is made to order, the confirmation of payment is an implied agreement between parties of an exchange of money for goods, as so our commitment is to deliver exactly what is paid for. 

  9. Storage fees of $100 per item per month for a maximum of 3 months will be applied to all unclaimed orders after 10 days of completion of the order.

  10. Storage fees for unclaimed orders will be added to the clients invoice. 

  11. If the customer is unreachable, does not reply to emails, leaves a balance owing, within 3 months of completion of the order or the payment due date, the order and money paid will be forfeit and the item will become the property of Harbottle Audio Ltd. and will be liquidated.

  12. Confirmation of your order is at the time when payment for the order clears the Harbottle Audio Ltd. bank account. 

    1. Once the order is confirmed as paid, the order will be logged in the build schedule.​

  13. Payment terms are upon receipt of the invoice plus 7 days (NET +7), unless otherwise stated in the invoice. 

    1. Incomplete payments will delay the order until the balance is paid. 

    2. Orders/Items will not ship until the client account balance is $0.00

    3. Harbottle Audio Ltd reserves the right to cancel unpaid invoices once the payment term has lapsed.

  14. Payment methods are available in the invoice. 

  15. Harbottle Audio Ltd is not responsible for misdirected funds and additional fees imposed by banking institutions or governments.

  16. Only CAD is accepted. If a non- Canadian currency is sent, please expect to be charged for all applicable banking fees and surcharges. 

  17. Acceptance of these terms and conditions is considered to show of intent to do business.

  18. Payment of the invoice is considered to be acceptance of the terms and conditions in whole.

  19. Communication for all Harbottle Audio Ltd clients is restricted to Harbottle Audio Ltd. Funk Audio is to be left to their manufacturing duties for the sake of fairness of working hours dedicated to all of our clients.
